On July 28, 2022, I Agent Charles was on duty, as a New Mexico State Police
Investigations Bureau Narcotics Agent. As NMSP Narcotics Agent I was working in an
undercover capacity in the city of Albuquerque, county of Bernalillo, state of New
Mexico.
While working in an undercover capacity I continued a narcotics investigation, by using
a social media account. Mr. Anthony Frank who was previously was identified on a previous narcotic purchase made by me. Mr. Miramontes advertise the sale of narcotic pills. He identified the narcotic pills as the blue round emoji with a white letter M on the emoji. An emoji is a small digital image or icon used to express and idea, emotion etc. Based on my training and experience the emoji described above is used by narcotics traffickers for fentanyl pills. I communicated via text message with Mr. Miramontes, and he texted me from phone number xxx-xxx-xxx.
On this date through text messages, I made arrangements to purchase two thousand (2,000)
pills of Fentanyl narcotics for $4,400.00. Mr. Miramontes advised me; he could sell me
the two thousand (2,000) fentanyl pills.
Mr. Miramontes agreed to meet with me at 150
98th St SW, Albuquerque, NM 87121. After negotiating a place to meet, I proceeded to the
above-mentioned address.
At this point of the investigation, I had prior knowledge that Mr. Miramontes had an
active felony warrant for trafficking-controlled substance. That warrant was drafted by
me, Agent Volk for 3 undercover/buy walks. Mr. Miramontes was updating me where he was
at via text and this information was relayed to the NMSP Crime Suppression (CS) Agents
(surveillance/take down team) in the area. Mr. Miramontes is known to show up in the
above-mentioned vehicle, red Chrysler 300, both passenger doors are gray/silver this
information was also relayed to NMSP CS Agents.
I observed Mr. Miramontes in above
mentioned vehicle arrive at above mentioned address, NMSP CS Agents on surveillance/
take down team waited until Mr. Miramontes parked and conducted a felony stop with the
emergency lights and sirens.
Mr. Miramontes put above mentioned car in reverse and attempted to escape the front in
containment. NMSP Agent Tony De Tavis and NMPS Units were able to contain the above-
mentioned vehicle, causing front end damage to above mentioned vehicle. Eventually, Mr.
Miramontes complied with commands and was taken into custody without incident. When
search incident to arrest, Mr. Miramontes was found in possession of a clear plastic
baggy with a large amount of small round blue pills. One side of the pill has a number
30 stamped, and the other side of the pill has the letter M stamped, based on my
training and experience these are the physical descriptors and characteristics a
fentanyl pills.
During the tow inventory of the above-mentioned vehicle, there was a two large clear
plastic bags with a large amount of small round blue pills. The container was located in
plain view by the rear driver side floorboard. One side of the pill has a number 30
stamped, and the other side of the pill has the letter M stamped, based on my training
and experience these are the physical descriptors and characteristics a fentanyl pills.
Also, in the rear driver side floorboard, $200.00 in U.S Currency was located and left
inside the vehicle. The tow inventory was stopped, the vehicle was closed and locked.
The vehicle was sealed. Based on this information the above-mentioned vehicle was towed
to Albuquerque NMSP District 5 office.
