San Jose Officer Shoots Suspect Armed With Knife During a Family Disturbance Call

San Jose, California — On November 17, 2024, at approximately 7:46 p.m., San Jose Police Officers responded to a residence in the 60 block of Sutter Street for a report of a family disturbance. A woman called to report the suspect, her intoxicated husband was in the kitchen throwing dishes at her. She said she had locked herself and four other children in a bedroom to get away from him. She stated she was scared to exit the bedroom because the suspect attempted to open the door with an unknown object and said he would kill her. Officers met with a family member outside of the residence who said he had to intervene between the suspect and a family member to stop him from physically assaulting the person. Police believe that the suspect had been armed with a knife and had slashed the arm of the family member that had intervened; the family member said he was able to disarm the suspect and get outside. Officers were able to get the Survivor and her children to exit the residence safely before making their way into the residence, in order to apprehend the suspect. once outside, the suspect’s 9-year-old child told officer the suspect has knives in the drawer.

Officers made an announcement they were entering the home and directed the suspect to come out and surrender. Officers entered a small bedroom, where they located him hiding under a large pile of clothing. Officers gave him multiple commands to show his hands and warned him that Force may be used against him if he did not comply. The suspect revealed himself as officers attempted to remove some clothing that covered him. The suspect emerged from hiding under the pile of clothing, armed with a kitchen knife. this put the officer within lunging distance of the suspect in the small room. Officers verbally alerted each other that the suspect had a knife, ordered him to drop the knife and began to withdraw from the room. As officers were withdrawing from the room, the suspect advanced on them with a knife raised. One officer discharged their Department issued taser at the suspect, however the suspect thwarted their efforts preventing the taser from being effective. The armed suspect continued to advance towards officers, approaching within several feet to the closest officer.

In response, one officer discharged their firearm, striking the suspect. After being struck, the suspect closed the bedroom door and barricaded himself in the room. Officers were not yet aware if the suspect had in fact been struck by gunfire. Officers then evacuated all the remaining residents to safety outside. Officers attempted to negotiate with the suspect to surrender and requested Special Operations Personnel, including Tactical Negotiators to respond to the scene. Negotiation attempts continued for several hours with no success. After repeated failed attempts to contact the suspect, Special Operation Personnel including tactical Medics and a police K-9, made entry into the bedroom to take the suspect into custody and to render medical aid. at approximately 11:50 p.m., the suspect was taken into custody and transported to a local hospital in critical condition. The suspect was later medically cleared and booked into the Santa Clara County Jail. The suspect was identified as 44-year-old Heraclio Mejia. His criminal history involves acts of Intimate Partner Violence and was also a Restrained Party in the served criminal protective order.
