Former prime minister Tan Sri Muhyiddin Yassin failed in his bid to restore his discharge and acquittal order on four abuse of power charges linked to the Jana Wibawa programme during his tenure.
A five-member Court of Appeal panel led by judge Datuk Azizah Nawawi dismissed the 77-year-old’s application for a review.
The 77-year-old was seeking a review of a previous panel’s decision which unanimously granted the prosecution’s application to set aside the Kuala Lumpur High Court’s order to acquit and release him in August last year.
Court of Appeal Judge Datuk Azizah Nawawi said that the earlier panel had the requisite jurisdiction to hear and adjucate the matter and therefore dismissed the application.
Muhyiddin, had on March 27 this year, applied for a review on grounds that the panel’s decision was null as it was made without the jurisdiction required under Section 50(1) of the Courts of Judicature Act 1964.
