Incident Summary:
LaDarius Butler has filed an *excessive-force* lawsuit against Aurora police after officers confronted him, his partner Jayla Houston, and their two young children in a Walmart parking lot on May 22, 2024, following a visit to Children’s Hospital Colorado for their 3-year-old son’s breathing issues. After receiving what they said was conflicting medical advice, the family left the hospital, which then reported a child endangerment case to police. Using cellphone tracking, Aurora officers located the family, blocked in their vehicle, and approached with weapons drawn while the family slept inside. Body-camera footage shows Butler repeatedly asking why police were confronting them and pleading not to be tased before Officer Adrian Arce-Cerda deployed a Taser and forced him to the ground. Butler was later charged with misdemeanor obstruction, though the charge was dismissed. His attorneys say the incident reflects ongoing issues within the Aurora Police Department, which is under a consent decree following the 2019 death of Elijah McClain, and argue the situation could have been resolved with a phone call. The city of Aurora maintains officers were responding to a kidnapping report from the hospital and says it will defend itself in the civil case.
