A fact can become evidence when it is relevant and can be proven in a court of law:
Relevancy
According to Section 5 of the Indian Evidence Act, 1872, evidence can be given of facts in issue and other relevant facts.
Proved
A fact is considered proved when the court believes it exists or considers it likely enough to act upon.
Disproved
A fact is considered disproved when the court believes it doesn’t exist or considers it unlikely enough to act upon.
Not proved
A fact is considered not proved when it is neither proved nor disproved.
Admissibility
The judge decides whether to admit evidence based on whether the fact would be relevant if proven.
A fact can be physical, like the arrangement of objects or the sound of a horn, or psychological, like a person’s intention to deceive.
