Anne Taylor argued that the prosecution should be prohibited from referring to the car seen in various surveillance clips as a singular “suspect vehicle #1” or as definitively a 2015 Hyundai Elantra, claiming it invades the jury’s role to decide whether those clips show the same vehicle. She pointed out inconsistencies in the timeline and in the shifting opinions of the State’s vehicle identification expert, FBI Agent Anthony Imel, particularly regarding the expansion of the vehicle year range after Kohberger was identified as a suspect.

Ashley Jennings countered that the expert’s analysis—comparing vehicle characteristics across multiple surveillance videos—should be enough for the State to present this evidence. Judge Hippler, unsurprisingly, sided with the prosecution. He dismissed Taylor’s concerns, repeatedly claiming the defense’s arguments were “not consistent with the facts,” though he later reiterated that deciding facts is the jury’s job—a standard that seems to shift depending on whether the defense or prosecution is arguing.

Once again, Judge Hippler’s approach raises serious questions about impartiality. The Defense’s efforts to challenge the narrative being fed to the jury were largely brushed aside. As usual, the judge seemed far less willing to interrogate the State’s conclusions, even when legitimate questions about the evidence’s reliability were raised.
