Supreme Court Spots WhatsApp Fraud In 41A CrPC Notices Instructions are Issued IPC Evidence BNS BNSS
INTRO:
For the offences with a sentence less than seven years of imprisonment, Supreme Court has directed that no person can be arrested by the Police. Alternatively, a notice under Section 41A CrPC will be issued to him informing about the case that has been registered against that person. The Investigating Officer or the IO is also empowered to take a bond from the accused whereby the accused will bound himself to appear for joining investigation or trial, Inquiry or other proceedings whenever and wherever he is so required to appear by the Police or the Court.
Sec. 530 BNSS has empowered the use of Electronic Modes and Audio Video Means of Communication in the Court proceedings.
The Police has started committing fraud on the process of law. they started the misuse of Sec. 530 BNSS and the Police had started sending notices through WhatsApp to pretend the service of notice on the accused through Electronic Modes.
Supreme Court has given directions regarding service of notice through Electronic Modes and Audio Video Means of Communication.
It has referred to an earlier Judgment of Delhi High Court.
