Police may register the FIR against the Accused person in a cheque bounce matter if the facts and circumstances of the case so warrants and if some cognizable offence has been committed. Both the cases i.e cheque bounce case under section 138 of the NI Act and the criminal case under FIR shall run simultaneously. Neither NI court is bound by police investigation nor police is bound by the outcome of cheque bounce case.
