In March of 2021, In St. Louis County, Missouri, Evita Tolu has filed a lawsuit against family court guardian ad litem (GAL) Elaine Pudlowski, psychologist James Reid, and clinical social worker Jennifer Webbe VanLuven. Tolu alleges that the trio conspired to exploit her custody dispute as an opportunity for personal gain, while subjecting her children to life with an abuser. The lawsuit outlines a scheme purportedly orchestrated by a group of professionals to financially drain parents entangled in custody battles, leaving them financially depleted and their children traumatized, while the GALs, court-appointed psychologists, and therapist’s profit.

According to Tolu, the alleged scheme kept her embroiled in court proceedings for three years, depleting her financial resources and alienating her from her children. The lawsuit contends that this pattern is commonplace in family court cases involving Pudlowski.

Tolu’s lawsuit further asserts that Pudlowski’s actions were not isolated incidents. Several other parents with cases concurrent to Tolu’s have reportedly faced similar experiences. For instance, one parent filed a Motion to Disqualify Pudlowski after she recommended custody to a father accused of sexual abuse, despite findings from the Division of Family Services and an ongoing criminal investigation. Despite these concerns, the court did not disqualify Pudlowski.
Another parent’s motion to disqualify Pudlowski was also denied after she placed a child with a father accused of molestation and substance abuse, violating GAL standards. In these cases, Pudlowski’s fees amounted to significant sums, adding financial strain to already stressed parents.

Moreover, Tolu alleges that Reid, the psychologist, engaged in unethical conduct, including falsifying testing data, altering evidence, and making biased diagnoses. Tolu claims that Reid diagnosed her and others with rare personality disorders, statistically improbable given the prevalence of such disorders in the general population. Reid’s purported actions prolonged court battles and enriched himself and his associates.

The lawsuit also implicates familial and professional ties, suggesting that Pudlowski’s marriage to former Appellate Judge Larry Mooney may have influenced court orders mandating the use of Reid’s services at exorbitant rates. Furthermore, Pudlowski’s purported relationships with circuit court judges raise concerns about impartiality and conflicts of interest.

Tolu’s case gained further attention when an email from Presiding Judge Michael Burton revealed prejudicial attitudes towards litigants and collusion among judges and GALs to strategize against Tolu. Following the revelation, all judges in the Saint Louis County Judicial Circuit recused themselves from the case, necessitating the Missouri Supreme Court’s assignment of a new judge.

In addition to seeking accountability for alleged misconduct, Tolu’s lawsuit sheds light on broader systemic issues within the family court system, where professionals exploit vulnerable families for financial gain. This case underscores the urgent need for transparency, accountability, and reform in family court proceedings to ensure the fair and just resolution of custody disputes.
